Which Court Handles South Bend Probate

South Bend is the county seat of St. Joseph County, and the county is unique in all of Indiana: it operates a dedicated St. Joseph County Probate Court. Every other Indiana county handles probate through its Circuit or Superior Court, but St. Joseph County has a separate Probate Court division. This is an important distinction when you are searching for records or planning to file.

Under IC 29-1-7-1, probate venue is set in the county where the decedent lived. South Bend residents' estates therefore go through St. Joseph County's Probate Court. The South Bend City Clerk, by contrast, handles city council records, ordinances, and municipal documents. It does not maintain any probate or court records. Marriage and court records for South Bend residents go through the St. Joseph County Clerk's Office, and birth and death records go through the St. Joseph County Health Department.

The Probate Court is physically located at the Juvenile Justice Center at 1000 S. Michigan Street, South Bend, IN 46601, which is different from the main county courthouse. Keep this in mind when planning an in-person visit for probate matters.
