Which Court Handles Muncie Probate

All probate matters for Muncie residents go through Delaware County. Indiana does not have city-level probate courts. The Delaware County Circuit Court (or Superior Court) handles estate administration, will filings, guardianship petitions, and related matters. Muncie is the county seat, so the courthouse is right in the city itself.

Under IC 29-1-7-1, probate venue is set at the county where the decedent was domiciled at death. Muncie residents fall under Delaware County jurisdiction. If a Muncie resident owned property in another Indiana county, that may affect where some ancillary proceedings happen, but the primary case belongs to Delaware County.

The Muncie City Clerk handles city court records, ordinances, and council minutes. Under Indiana Code IC 36-4-10, the city clerk maintains those municipal records and also serves as clerk of the Muncie City Court. But city court handles misdemeanors and infractions, not probate. Do not contact the city clerk's office for wills or estate records.

Types of Probate Records in Muncie

Delaware County Circuit Court maintains the full range of probate records for Muncie residents. Probate records are generally public, though some types are restricted by law. Common record types include:

  • Wills filed for probate following a death
  • Estate administration files (supervised and unsupervised)
  • Letters testamentary and letters of administration
  • Guardianship cases for minors and adults who cannot care for themselves
  • Conservatorship filings
  • Trust registrations and accountings filed with the court
  • Small estate affidavits under IC 29-1-8-1

Indiana's small estate process lets heirs skip full court administration for modest estates. If the total value falls under the state threshold, a small estate affidavit may be used. For larger or disputed estates, the Delaware County Circuit Court oversees the full administration process. The clerk's office can confirm which process applies.

Probate Filing Fees

Indiana sets probate filing fees by statute. IC 33-37-4-7 sets the Probate Costs Fee at $120. With other required fees added, a standard estate filing in Delaware County runs around $177. The exact total depends on the case type and any additional filings made during administration.

Copy fees at the Delaware County Clerk are $1 per page under IC 33-37-5-1. Certified copies cost an extra $3 per document under IC 33-37-5-3. The Muncie City Clerk uses the same copy fee schedule for city court records: $1 per page plus $3 for certification. Court payments can be made online at publicaccess.courts.in.gov/pay.
